A thump on the head to BOTH CM and EBAY for not using common sense! BOTH are responsible for putting you thru this and BOTH owe you an apology and need to do something to rectify it! Frankly it gives them both a bad name PR wise. I am NOT a paper scrapper so could care less what CM does and while sometimes I have bought their products after reading this I may think twice as I really don't need it! Ebay can be a pain in the tush by NOT telling folks things they should have to..Any store owner would have to explain things why should they think they don't have to? It's just absurd that they did this to you and I sure hope its resolved quickly and to your satisfaction! Anyone from CM or Ebay that reads this should take it to heart...the digi community does use their services too and we want to know when things are wrong and word does get around!

Someone else ran into a similar problem with another company and she tried to fight it. eBay's response to her was "If they pay, it's okay." I'm not quite sure what that means.

No one ever did get back to me and all I ever got from eBay was a canned response "blah, blah, blah, contact the company who's trademark you violated, blah, blah, we don't investigate, yada yada." From eBay's response, anyone who is a member of VERO can fill out an "affidavit" and complain about anyone for anything and eBay will just take their word and that's final. Problem I have is that in this so-called "affidavit", they claimed "under the penalty of perjury" I infringed upon their trademarked name. I did no such thing as they do not own the trademark or copyright to "creative" and "memories" as individual words, so they lied.

If you read CM's About Me page on eBay, which is nothing more than a Terms of Use/Disclaimer page, they do have a paragraph stating that they will report any auction using the components of their name in the auction title, whether they are together or not. I guess if I make my own About Me page, I can make my own laws too? Because essentially, that's exactly what they did.

It's not a big deal, changing my title is all I need to do but I was just so blown away because for such a silly reason and without warning, I was being punished for something really awful. Copyright and Trademark infringement is not a joke and to have that mark on me when I didn't even do anything wrong really tore me up.

I have never been a fan of CM and this just reinforces what I think about them. They have some decent tools, but their paper, stickers and style are just plain boring. Let's start an anti-CM movement! hehe, just joking...I really do not care for CM though!

yeah, let's not bash CM here, as we do have CM consultants on these forums.
The ebay thing, while it sucks that they did it, I can't say that I don't understand. yeah, CM is being petty about the name usage, and ebay, in a perfect world would contact everyone who is reported each day, but there must be a LOT of complaints. Think about all the listings. Anyway, I hate it when i do a search for something like say, Creative Memories just for example, and a listing like yours comes up. I'm not saying you did anything wrong, but to me, sitting here on the other end of the auction, it looks like the seller purposely used those two words in their description to attract more interest. Think about it? How many more hits would your auction get if it were stuck in the middle of a Creative Memories auction then if you had just said something to the effect of "personalized srapbooking pages" or whatever? KWIM? Again, it doesn't sound like YOU did it on purpose, but I know that many do. So i'm just saying that I understand where everyone is coming from. Just thought I'd offer that perspective.
