Exclamation Copy right Do's & Don'ts and When it's OK to Copy

I posted this link in another thread, but given the questions think it's a good idea to pull it out on it's own for reference for everyone. It's a series of articles on copyright that includes a good overview of the laws with follow on articles that go to the very heart of what we're talking about here.

The author is an artist herself and has done some pretty extensive research to put these articles into layman's language. She is also the author of Electronic Highway Robbery: An Artist's Guide to Copyrights in the Digital Era published by Peachpit Press.

Copyright Question

Susan,

So what is the rule if someone comes to you with a picture say, of their daughter's senior picture, taken by a professional photographer, but they want a scrapbook page made from that copyrighted picture? Do they need permission from the photographer in order to have the picture scanned to put in a layout designed by someone else?

Yes, they need permission from the professional photographer that took the photo.

(However, I have had some professional photographs taken where I bought the negatives and am allowed under the contract to make as many copies as I'd like. In a case like that, it would be OK to use the photo.)

in that case, you could also take the measurements of the photo and scrap a page with a blank space for the photo to be attached (the old-fashioned way LOL) after the page has been printed - kinda like a plopper

Even if she wanted to scan the photo herself she would need permission from the photographer

coypright issue

I want to use some coin images to make a piece of paper. Is this a copyright issue?

I know it's illegal to copy paper bills (they have a term for it it: counterfeit! No joke, with today's technology, it can be done and the treasury department takes it very seriously.), however, I don't know if coins are the same as they are a different material. To be sure, you can check with the Treasury department. Easiest to do is Google search!

I actually didn't have a whole lot of luck finding a definitive answer. I think it may be acceptable, IF, you write "copy" on them. You can make the word "copy" like a watermark, translucent, so unless you look for it, you don't notice it imediately. Wish I could have found a more complete answer. If you find out more, please post back here for future reference!
