Question Copyrights on portraits within a layout?

Can anyone tell me what the general consensus is about getting your digital layouts printed at shutterfly, costco, etc... WHEN you have a professional portrait(s) incorporated into your layout? Do they still refuse to print it since you are not the original photographer nor have written permission to reproduce it?

If so, does this then rule out ever doing a layout with my old school pictures or even our wedding pictures for example...?

I've had a few that they refused to print that had one that looked professional but my fil had taken it (he was into photography). They just said it "looked" professional so they couldnt' do it. I own the copyright to my wedding photos. We got all the negatives as part of our package.

This is a double edged question for me... With the advent of the "do it yourself" style kiosks at almost every store in the universe now, and being a professional photographer, it is so easy for anyone to purchase a single print from me and then just make copies from that... not legal.. but that's life.

Now, for your situation, if the photo is older than say 20 years... I wouldn't worry about scanning and then reprinting either as a print or as part of a layout. I'm sure you technically would need to attempt ot contact the photographer, etc... but no one is going to do this. If the photo was newish (<5 years), then I would say you do need to contact the photographer or studio for permission.

As an aside.. if anyone purchased photos from me and wanted to use them for another purpose... I'd be happy to let them do it - and be thankful they contacted me for permission. Good Luck.

Try it! Some are sticklers while I had one site tell me that "they don't really police that." You may get lucky and not have any problems.

I know that Shutterfly supposedly has someone who checks on it. They used it as an excuse for a week delay in my shipping on 2 QP's I did. The only thing I could think of when they said it had to be "copywrite" verified was that one was a pix I took of friends who had just gotten married and it was a picture of their 2 hands showing the wedding rings. Personally, I think it was just an excuse for the shipping delay. They in no way looked professional. I took them. lol'

I think Pesto makes a good point on this one. The photographer who took my school photos actually also dose my dd school photos... and I asked him about this. He said they have no problem with people scanning in childhood school photos... and as far as my dd photos he said that he could probably work out something for me with the digital negs and a copy right. Both the school photographer and my wedding one told me the same thing.. they only keep negatives for 7 years.... now with both working in digital they are still debating on what the new polie is going to be... but I own the negs from my wedding so I dont have a prob ther... I boutht them abouth 6 years after i got married.

So far I've done all my own printing, but I'm definitely thinking about having it done for me. When I do layouts for myself to post here or on other sites, my personal policy is to always give credit to the photographer -- if I know who took it. I give credit to the designers, so I feel what is one more line to give credit for the professional photos. I know about ten years ago we had some professional photos copied, and we had to show a letter of release to have them done. I guess the best policy is just to not use the recent professional pix in a produced book.

Thank you all for your input. So basically if I have any problems, try, try again... eventually someone will let me do it?

Any problems with snagging Trademarked graphics off the internet... like say Disney characters, or company Logos, etc? Or has the whole digital/internet era really muddied up the waters in that area too?

Sigh, I'm not even trying to sell anything. I just want to make sure I can get them printed somewhere.
