How do I cut out a curve shape?

Hi

I'm trying to cut a curvy wave shape out of one background to lay over another background. How do I do this in PSCS? I have tried freehanding it (with the mouse) but it looks too crooked, tried the pen tool but I can't get it to turn my line into a selection so I can cut out the piece.

Any ideas for me???

when youuse the pen tool to turn it to a selection go to the bottom right in your layers/paths pallette and change work path to selection ,you will see a dotted circle .hope that helps.
